The Cube Lab - Terms and Conditions

Instructions: We will commence work on the project usually within 7 days of receiving your order. The build process will then start as soon as the design is agreed and paid for and will continue until the project is complete. We rely on the client’s material and feedback in order to complete any project and so it is important to the successful completion that this is made available as quickly as possible.

Communication: Apart from our initial meeting, we will normally communicate with you by telephone or e-mail, as appropriate.

Contract: The client’s approval for work to commence shall be deemed a contractual agreement between the client and The Cube Lab. Important: Approval for the work to commence and payment of the deposit indicates that the client accepts these terms and conditions.

Material: All material supplied by the client shall remain the client’s property. It will be assumed that this material belongs to the client and that it does not breach any copyright laws.

Domain Name Registration & Website Hosting Charges: The Client shall meet all third party costs arising from the registration of domain names and the configuration of any hosting. Any domain names registered by us will be in the client’s name. We will suspend any hosting and/or domain names and/or e-mail accounts if any due invoices are unpaid.

Intellectual Copyright: We will retain the copyright of any material, including the source code, created for the client by us until payment of the final invoice. At this time it will become the property of the client. A copy of the site files will be made available upon request. Some source files, such as those for some database applications, shall remain the copyright of The Cube Lab. The creation of marques (logos and identities for example) by The Cube Lab are not assumed by The Cube Lab to become or act as trade or registration marks on behalf of the client.

Search Engine Promotion: Unless requested, we are not responsible for the client’s on-going web site promotion. We make no guarantees about the success of any search engine promotion activity because the search engines control this. However, we will build the website with search engine optimisation in mind by using the latest search engine friendly techniques. If you have ordered an on-going SEO package, any advice we may provide is not regulated and the client is not obliged to take action on this advice. The Cube lab is not responsible or liable for any loss or damage incurred to your business as a result of this advice.

Cancellation: Should the client wish to cancel at any point during the process they shall remain liable for the work that has taken place and shall be invoiced accordingly.

Delay of work: Should the project be delayed for any reason that is out of the control of The Cube Lab, an invoice will be raised for the work carried out so far; regardless of whether the project has been completed.

Travel Time and Expenses: Travelling time to and from customer premises is not included in our quotation and we reserve the right to make a charge for travelling at our normal rates should further visits to the client’s premises be required.

Quotations: The price quoted to the client is for the work agreed on the quotation only. The order form provides the statement of engagement and should the client decide that changes are required after the statement of engagement has been issued, we will accept these alterations subject to any agreed changes to both timescale and cost. A new statement of engagement will be produced to cover the changes.

Advance Payment: An advance of the total cost of the project is required before work can commence. After work commences this is non-refundable, though will be returned if no work has started.

Payment terms: Payment is accepted by cheque or bankers draft in UK Pounds Sterling.

Payment: An invoice for the balance of the quotation will be sent by e-mail or post upon satisfactory completion of the project and before the services are published. Payment of this invoice will be due immediately. Accounts that have not been settled within 7 days of our final reminder will incur a late payment charge of 10% of the amount outstanding. The website or other services will not be published until the final payment has been received. Any domain names and / or hosting and e-mail services will be suspended if payment is not received.

Future Support: The website is provided to and accepted by the client as a fully functioning, completed project. We are not responsible for future support and our liability of any loss of data is limited to the value of the project. On-going support can be provided upon request and for an agreed fee. Future changes to the website will be invoiced at our prevailing hourly rate. The Cube Lab is not responsible for any loss or damage caused by the supply of digital files, printed media, CD or DVD discs. The Cube Lab endeavour to ensure that any digital files supplied via e-mail or disc are virus free. It is the client’s responsibility to ensure that media received from The Cube Lab is virus free.

Future Problems: Unfortunately malicious software, spyware, viruses and website hacking are facts of life on today’s Internet. It is unlikely that these will affect your website, and we will endeavour to protect it from this as much as we can during its creation, but we cannot be held responsible for problems that develop on your site after we have handed them over to the client.

Loss: The Cube Lab is not liable for any consequential loss due to the website being off-line for any reason. There are occasions when maintenance or upgrade work is required to be carried out on the server where the client’s website is stored. If this is the case we will notify the client. Downtime is usually just a few hours and is very unlikely. Our liability is limited to the initial value of the project.

Data Protection: We occasionally collect client’s data during the process of carrying out a project. This data will not be shared with anyone else and will be stored in such a way as to not be available to anyone else.

Confidentiality: We will not discuss your project or share your details with any third party not involved with the development of the website.

e-mail and computer advice: We are web designers and not PC technicians and so are not able to provide advice and support for any computer issues. If you need assistance with the configuration of your e-mail, we can offer recommendations as to whom to contact.

By agreeing to these terms and conditions your statutory rights are not affected.

The Cube Lab reserve the right to change or modify any of these terms or conditions at any time. Should clarification of any of the above be required please contact us.
